Zombie Math Terms of Service
Effective date: October 3, 2026
These Terms of Service (the "Terms") are a binding agreement between you and Best Friend Labs ("Best Friend Labs," "we," "us," or "our"), the owner and operator of Zombie Math, available at zombiemath.org and any related applications, pages, and services (together, the "Service").
Please read these Terms carefully. By creating an account, clicking "I agree," or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms include a binding arbitration provision and a class-action waiver (Section 18) that affect how disputes are resolved.
1. Who may agree to these Terms
1.1 Adults only. You must be at least 18 years old and able to form a binding contract to accept these Terms and hold an account as a parent, guardian, teacher, or organization administrator (each, an "Account Holder").
1.2 Students. Students do not agree to these Terms themselves. Student accounts are created and controlled by an Account Holder: a parent or guardian, or a teacher or school acting with proper authority. The Account Holder who creates or manages a student account accepts these Terms on behalf of that student and is responsible for the student's use of the Service.
1.3 Organizations. If you create or manage an account on behalf of a school, district, tutoring business, or other organization (an "Organization"), you represent that you have authority to bind that Organization to these Terms, and "you" includes the Organization.
2. Description of the Service
Zombie Math is an online mathematics practice program that presents generated problems, guided practice, worked solutions, fact drills, progress reports, and related teaching tools. The Service is offered as a supplement to instruction. It is not a school, a licensed educational institution, a tutor, or a substitute for a qualified teacher.
We may add, change, limit, or remove features at any time. Features described in marketing material, documentation, or roadmaps are not promises that those features exist or will continue to exist.
3. Accounts and security
3.1 Accurate information. You agree to provide accurate information when registering and to keep it current.
3.2 Credentials. You are responsible for all activity under your account and under any student accounts you create or manage, whether or not you authorized it. Keep passwords, student credentials, sign-in links, and Live Session links confidential. Do not share an account with anyone else. Notify us promptly at hello@zombiemath.org if you believe an account has been compromised.
3.3 Student credentials. Student usernames and passwords are generated by the Service or set by the Account Holder and are delivered by email to the Account Holder. We do not keep a recoverable copy of a student's password. If it is lost, the Account Holder must reset it through the Service.
3.4 One person per account. Each student account is for a single student. Each Account Holder account is for a single adult.
3.5 Throttling and security measures. We may rate-limit, lock, or temporarily block sign-ins, sign-ups, or other activity that appears automated, abusive, or unsafe, without notice.
4. Privacy
Our collection and use of information is described in our Privacy Notice, which is incorporated into these Terms. In summary, the Service is designed to collect as little personal information as possible:
- Account Holders: an email address, a password (stored only as a hash), and, for teachers, an optional display name.
- Students: a generated or teacher-assigned username, a password hash, and learning-activity data such as answers, scores, skill mastery, time on task, and session history. We do not ask students for their name, email address, birth date, school, or location.
- Operational data: we keep hashed (not raw) email and IP values for a short period to prevent sign-up and sign-in abuse, and standard server logs.
- Live Teaching Sessions: participants in a Live Session do not need accounts, and nothing about a Live Session participant is stored in our database.
We use third-party infrastructure providers (for example, hosting, database, and email-delivery services) to operate the Service. Those providers process data on our behalf.
5. Children's privacy and consent
5.1 Parents and guardians. By creating a student account for a child under 13, you represent that you are the child's parent or legal guardian and you consent to our collection and use of the child's information as described in Section 4 and the Privacy Notice. This is your verifiable parental consent under the Children's Online Privacy Protection Act ("COPPA").
5.2 Teachers and schools. If you create student accounts as a teacher or Organization, you represent that (a) you are authorized by the school or Organization to do so, (b) the school or Organization has obtained any consent required from parents or guardians, or is providing consent on their behalf as permitted by COPPA and applicable state law, and (c) you will use student accounts only for educational purposes within the school context. Best Friend Labs relies on these representations.
5.3 Review and deletion. A parent or guardian may review a student's learning data through the parent/guardian dashboard, and may request deletion of the student's account and data by contacting hello@zombiemath.org. A school or Organization may request deletion of the student accounts it created.
5.4 No advertising to students. We do not show third-party advertising to students and do not sell student data.
6. License and acceptable use
6.1 License. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for its intended educational purpose.
6.2 Restrictions. You agree not to, and not to allow any student or other person under your control to:
- copy, scrape, download, or extract problem sets, solution traces, hints, artwork, or other Service content, whether manually or by automated means;
- reproduce, distribute, sell, sublicense, rent, or otherwise commercially exploit any part of the Service;
- reverse-engineer, decompile, or attempt to derive the source code, problem-generation logic, or scoring logic of the Service;
- tamper with, manipulate, or falsify scores, progress, mastery data, or reports, or help anyone else do so;
- access the Service through any means other than the interfaces we provide, or use bots, crawlers, or scripts against the Service;
- bypass, disable, or interfere with security, rate-limiting, or access controls, including using an account, link, or token that was not issued to you;
- upload or transmit malicious code, or take any action that imposes an unreasonable load on our infrastructure;
- harass, threaten, or harm any other user, or use the Service to collect information about students beyond what the Service itself provides to you;
- use the Service to build a competing product, or to train machine-learning models on Service content;
- use the Service in violation of any law, including student-privacy and data-protection laws; or
- misrepresent your affiliation with a school or Organization, or your authority to create student accounts.
6.3 Security research. Do not probe or test the security of the Service without our prior written permission.
7. Intellectual property
7.1 Our property. The Service and everything in it, including the Zombie Math name and logo, characters, avatars, artwork, posters, lesson content, problem generators, solution traces, hints, explanations, curriculum structure, software, and design, are owned by Best Friend Labs or its licensors and are protected by copyright, trademark, and other laws. Except for the limited license in Section 6.1, no rights are granted to you. All rights not expressly granted are reserved.
7.2 Trademarks. "Zombie Math," "Best Friend Labs," "Zombie Royale," and related logos are trademarks of Best Friend Labs. You may not use them without our written permission.
7.3 Printable materials. Where the Service lets you print or download materials such as unit posters or progress reports, you may use them for personal, classroom, or non-commercial educational purposes only, with attribution intact.
7.4 Feedback. If you send us ideas, suggestions, bug reports, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without obligation to you.
8. User content
8.1 The Service allows limited user input, such as class names, teacher display names, Live Session handles, and content flags or reports. You are responsible for whatever you submit. Do not submit anything unlawful, offensive, infringing, or that contains personal information about a student that the Service does not ask for.
8.2 You grant Best Friend Labs a non-exclusive, worldwide, royalty-free license to store, display, and use anything you submit as needed to operate, maintain, and improve the Service, including to fix problems in lesson content that you report.
8.3 We may remove or edit user content at our discretion, and we have no obligation to monitor it.
9. Live Teaching Sessions
9.1 A teacher who opens a Live Teaching Session controls that session and is responsible for who receives the session link and for the conduct of participants. Session links are unauthenticated: anyone with the link can join. Share links only through channels you trust.
9.2 Live Sessions are ephemeral. When the teacher closes a session, or the teacher's connection ends, the session and everything in it are gone. We do not record, store, or restore Live Sessions and are not responsible for lost session state.
9.3 You may not record, capture, or redistribute other participants' activity from a Live Session except as permitted by your school's policies and applicable law.
10. Educational content disclaimer
10.1 Problems, hints, solutions, explanations, and reports are generated automatically and may contain errors, ambiguities, or approaches that differ from what a particular teacher or curriculum expects. We work to find and fix mistakes, and you can flag content from within the Service, but we do not warrant that any content is error-free.
10.2 References to grade levels, state or Common Core standards, or "coverage" describe our own mapping and are provided for convenience. They are not a certification by any standards body, state, or district.
10.3 We make no promise about any educational outcome, including grades, test scores, mastery, placement, or credit. Scores, mastery levels, streaks, and other measures shown in the Service are for practice and motivation and are not an assessment of record.
10.4 Zombie-themed content is fictional and intended to be light-hearted. If a student finds any of it upsetting, the Account Holder should stop the student's use of the Service and contact us.
11. Fees, free access, and changes
11.1 Some or all of the Service is currently offered free of charge. We may introduce fees, paid tiers, seat limits, or usage limits at any time. We will give reasonable notice before charging for a feature that was previously free, and you will never be charged without agreeing to the price.
11.2 If you purchase a paid plan, the price, billing period, and refund terms presented at the time of purchase apply. Unless stated otherwise at purchase or required by law, fees are non-refundable.
11.3 We may modify, suspend, or discontinue all or part of the Service, including free access, at any time. We will try to give notice of discontinuation and, where practical, a way to export progress data, but we have no obligation to maintain the Service or your data indefinitely.
12. Third-party services
The Service depends on third-party providers for hosting, databases, real-time messaging, and email delivery. We are not responsible for outages, delays, data loss, or security incidents caused by those providers, by your device, network, or email provider, or by anything else outside our reasonable control.
Emails from the Service, including credential and sign-in-link emails, may be delayed, filtered, or blocked by your email provider. You are responsible for keeping those emails secure once delivered.
13. Organizations and schools
13.1 An Organization's administrator may create teacher accounts, allocate seats, and manage classes and student accounts within the Organization. The administrator acts for the Organization, and the Organization is responsible for the acts of its administrators, teachers, and students.
13.2 Student learning data created within an Organization's classes is education-record data controlled by the Organization. To the extent the Family Educational Rights and Privacy Act ("FERPA") applies, Best Friend Labs acts as a "school official" with a legitimate educational interest, under the Organization's direct control, and uses that data only to provide the Service.
13.3 If an Organization requires a separate data-privacy agreement under state law, that agreement, once signed by both parties, controls over these Terms for the matters it covers. Absent a signed agreement, these Terms govern.
13.4 An Organization may not transfer seats or accounts to another Organization without our consent.
14. Suspension and termination
14.1 By you. You may stop using the Service at any time and may request deletion of your account and any student accounts you control by contacting hello@zombiemath.org.
14.2 By us. We may suspend or terminate any account, or restrict access to any part of the Service, at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us or other users, or if the account has been inactive for an extended period. We may also terminate for any other reason on reasonable notice.
14.3 Effect. On termination, your license ends immediately. We may delete account data after termination and are not obligated to retain or return it. Sections that by their nature should survive (including 7, 10, 15, 16, 17, 18, and 19) survive termination.
15. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, BEST FRIEND LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT CONTENT IS ACCURATE OR ALIGNED TO ANY STANDARD, OR THAT THE SERVICE WILL PRODUCE ANY PARTICULAR EDUCATIONAL RESULT.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BEST FRIEND LABS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, PROFITS, GOODWILL, OR EDUCATIONAL OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).
These limitations are a fundamental basis of the bargain and apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless Best Friend Labs and its owners, employees, contractors, and suppliers from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service or the use by any student or person under your control; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; (d) any inaccuracy in a representation you made about your authority to create student accounts or to consent on a child's behalf; or (e) anything you submit to the Service. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with us.
18. Governing law and dispute resolution
18.1 Governing law. These Terms are governed by the laws of the State of Oregon and applicable United States federal law, without regard to conflict-of-laws rules.
18.2 Talk to us first. Before starting any formal proceeding, you agree to contact us at hello@zombiemath.org with a description of the dispute and give us 30 days to try to resolve it informally.
18.3 Binding arbitration. Except as provided in 18.4 and 18.5, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Oregon. The arbitrator may award the same individual relief a court could. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs this Section.
18.4 Exceptions. Either party may bring an individual claim in small-claims court in Multnomah County, Oregon, and either party may seek injunctive or other equitable relief in court to protect intellectual property or to stop unauthorized access to the Service.
18.5 Opt-out. You may opt out of arbitration by emailing hello@zombiemath.org within 30 days after you first accept these Terms, with the subject "Arbitration opt-out" and the email address on your account. If you opt out, disputes will be heard exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to their jurisdiction.
18.6 Class-action waiver. YOU AND BEST FRIEND LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable for a particular claim, that claim will proceed in court, not arbitration.
18.7 Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.
18.8 Organizations. A signed agreement between Best Friend Labs and an Organization may specify different dispute-resolution terms, in which case that agreement controls for the Organization.
19. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will give notice by email to the address on your account, by a notice within the Service, or both, at least 14 days before the change takes effect, unless the change is required by law or addresses a security or abuse issue. The "Effective date" above shows the current version. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Service and request deletion of your account.
20. General
20.1 Entire agreement. These Terms, together with the Privacy Notice and any signed Organization agreement, are the entire agreement between you and Best Friend Labs about the Service and replace any prior agreements.
20.2 Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full effect.
20.3 No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
20.4 Assignment. You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets, and will honor Section 19 for any material change that results.
20.5 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
20.6 Electronic communications. You consent to receive notices and communications from us electronically, at the email address on your account or within the Service, and agree that they satisfy any legal requirement that a communication be in writing.
20.7 Export and sanctions. You may not use the Service where prohibited by U.S. export-control or sanctions laws.
20.8 No third-party beneficiaries. These Terms do not create rights in any third party, except that our owners, employees, contractors, and suppliers may enforce Sections 16 and 17.
20.9 Headings. Headings are for convenience only and do not affect interpretation.
